Terms and conditions

Turrabuel, a company of Tonag AG, Zug

1. General

The general terms and conditions form part of the contract between you (hereinafter also referred to as the “contractual partner”) and us, the provider Turrabuel, a company of Tonag AG, Bahnhofstrasse 10, CH-6302 Zug, hereinafter referred to as Turrabuel.

2. Booking and Conclusion of Contract

2.1 By making a verbal, written (including email), or electronic (including internet) booking, you enter into a contract with Turrabuel. From that moment, the rights and obligations arising from the booking and these terms and conditions become effective for you and Turrabuel. You will receive a written booking confirmation/invoice from Turrabuel promptly.

2.2 If the booking confirmation/invoice deviates from the description on www.turrabuel.ch, you acknowledge the conclusion of the contract based on the booking confirmation/invoice by making the deposit. Please note that you are booking an apartment category, not a specific apartment.

2.3 If no deposit or recognized proof of payment is received by the contractual partner within the period specified in the booking confirmation/invoice, Turrabuel may freely dispose of the booked property.

2.4 Special requests on your part will be gladly accepted by Turrabuel as non-binding wishes. There is no legal entitlement to their fulfillment unless Turrabuel has confirmed them in writing.

3. Services/Prices

3.1.1 The published prices are valid until the website is updated. Subject to section 3.5 (“Price Changes”), the prices valid at the time of booking apply. If there are several equivalent apartments in a building with the same number of rooms, occupancy, and prices, only one apartment of this category is listed on www.turrabuel.ch and in the price list. Special promotions are not always valid for all apartments in the same category.

3.1.2 The rental price does not include the costs for the tourist tax (for persons aged 16 and over) and the underground parking space. These are listed separately in the booking confirmation/invoice.

3.1.3 The minimum rental period is indicated in the respective valid price lists. Generally, apartments can be booked daily with a minimum stay of 3 days. Exceptions are possible upon request and with written confirmation from Turrabuel.

3.2 The infrastructure facilities (transport, shops, restaurants, sports facilities, etc.) mentioned in the brochure, on the website, and in the booking/travel documents are not part of our service obligations. These facilities decide their operating hours and similar matters independently. The same applies to public and private utility providers (e.g., water and electricity companies). Information about climatic conditions does not constitute a guarantee. Any applicable disclosure, notification, and due diligence obligations on our part remain unaffected.

3.3 Payments
The rental amount for the booked property must be paid before the start of the trip as follows:
50% of the rental amount for the reserved property is due within 56 days of booking. The remaining balance is due to Turrabuel 56 days before the rental start. For short-term bookings made less than 30 days before the rental start, the full rental amount is due immediately upon booking and must be transferred to Turrabuel. If the remaining balance or the full rental amount for short-term bookings is not paid on time, Turrabuel may refuse to provide the services.

3.4 Cancellation Fees
In case of cancellation by you, the following cancellation fees will be charged:
· Up to 56 days after the booking date: 0% of the rental price is due
· From 56 days before the rental start until the arrival date: the full rental price is due.
The date of receipt of your written cancellation by Turrabuel at the email address info@turrabuel.ch is decisive. If the property is not occupied or is occupied late, the full invoice amount remains due. We recommend taking out additional travel insurance. Claims under any insurance contract can only be made by the insured person against the insurer.

In the case of travel restrictions, border closures, quarantine requirements, facility closures (e.g., cable cars), or similar circumstances related to a pandemic (e.g., COVID-19), the rental amount paid by you cannot be refunded. However, as a gesture of goodwill, we offer to reschedule your booking to another period in the low season; the low season includes the months of May and June, as well as mid-August to mid-December.

3.5 Price Changes
The property descriptions and price calculations have been prepared with care. Nevertheless, we cannot entirely rule out changes to services and/or prices. These will be communicated to you with your valid booking confirmation/invoice.
Changes to services after the conclusion of the contract are unlikely but cannot be entirely ruled out. If there is a significant change to an essential contract point, you have the right to withdraw from the contract free of charge within five days of receiving the notification. Any payments already made will be refunded immediately.

3.6 Service Changes, Substitute Rental, and Contract Termination
Turrabuel is entitled to terminate the contract before or during the rental period if unforeseen or unavoidable circumstances prevent the handover of the rental property, endanger the tenant or the property, or impair the provision of services to such an extent that fulfilling the contract is no longer reasonable. If we notify you before the trip begins, we will endeavor to provide a comparable rental property within 10 days, if possible, from our offerings at no additional cost. Turrabuel is not liable for damages in any of the cases mentioned in section 3.6.

4. Occupancy

The rental property may only be occupied by the specified number of persons (including children and infants). Over-occupancy entitles Turrabuel to refuse key handover or to immediately revoke the key during the rental period.

5. Additional Tenant Obligations

5.1 Duty of Care
The rental property must be used with care. Local house rules apply, and consideration (noise, behavior) must be shown to neighbors. Please note that all apartments are non-smoking.

5.2 Kitchen Cleaning
The cleaning of kitchen facilities, appliances, dishes, and cutlery is the tenant’s responsibility and is not included in the final cleaning.

5.3 Liability for Damages
Any damage caused by the tenant or co-users must be reported to Turrabuel’s management. The tenant is liable for any damage caused by themselves or co-users. The same applies if the apartment cannot be handed over to subsequent tenants.

5.4 Dogs
Your four-legged friends are warmly welcome at Turrabuel. We assume they are house-trained and harmless. Please consider subsequent tenants: seating and beds at Turrabuel should be reserved for humans.
Please note that leashes are required within towns and near cross-country ski trails. In the publicly accessible indoor and outdoor areas of Turrabuel, we also ask you to keep your dogs on a leash.

6. Obligation to Report Defects and Claim Deadlines

If the property is not in the condition specified in the contract or if you suffer damage, this must be reported to Turrabuel’s management immediately. If no immediate report is made upon taking possession, the property is presumed to be free of defects. The same rules apply if defects arise during the rental period.
External conditions and regional characteristics, such as unfavorable weather or the condition of public dirt roads, do not entitle you to compensation claims.

7. Turrabuel’s Liability

Statutory liability for damages other than personal injury (e.g., property or financial damage) is limited to the rental price (with the claims of all involved persons combined). If international agreements or national laws apply to Turrabuel’s services that further limit or exclude liability, those agreements or laws apply. Turrabuel is not liable if the damage is due to the following causes:
· Actions or omissions by you or a co-user
· Unforeseeable or unavoidable failures by third parties not involved in providing the contractual services
· Force majeure or events that Turrabuel could not foresee or prevent despite due care
· Damages and losses due to burglary
· Damages and losses in the underground parking
· Public access roads and resulting personal or property damage. Liability for auxiliary persons is expressly excluded. These provisions apply analogously to non-contractual liability.

8. Ombudsman

Before pursuing legal action or for legal questions related to this contract, you may consult the Ombudsman of the Swiss Travel Industry (www.ombudsman-touristik.ch). The Ombudsman strives for a fair and balanced resolution of any issues between you and Turrabuel or an intermediary through whom you booked the trip.

9. Statute of Limitations

Claims for damages against Turrabuel, except for contractual claims, expire within one year. The limitation period begins on the day following the end of the rental period.

10. Choice of Law and Jurisdiction

The relationship between you and Turrabuel is governed by Swiss law. You may only sue Turrabuel in Zug. Turrabuel may sue you at your place of residence or in Zug.
